Fulton County's Family Division
The Family Division was instituted in Fulton County as a pilot project to reform divorce and custody law. The basic premise of the system is to consolidate fragmented issues involving one family (custody, abuse, domestic violence, divorce) and have them overseen by one judge. This streamlines the judicial process and provides continuity for families.
30 day Status Conference
Fulton County endeavors to make family law cases less adversarial by having initial status conferences. Even though these proceedings are less adversarial, they still require a great deal of preparation. When any family law case is filed, a 30 Day Status Conference is scheduled at which the parties and their attorneys appear to meet with a judicial officer. The judicial officer is a judge and can make decisions impacting your case. At the conference, each party must present a Domestic Relations Financial Affidavit, Interrogatories, and Documents related to the case. Edwards & Associates has converted all of these forms to electronic format so they may easily be sent to the client for completion.
Other Family division procedures
In addition to the initial 30 Day Status Conference, there are other court appearances , including the 60 Day Status Conference, mediation, temporary hearings, and a final trial if required. Decisions can be made by the Court at any juncture, and especially in an emergency situation. However, the parties are afforded numerous opportunities to attempt to resolve their case without litigation. Fulton County pays for 2 mediation sessions in an attempt to help parties resolve their case.
